so I just put my cub top end and a set of strait cut gears in and it smoking really bad out the clutch side pipe and it smells like gear oil so I'm thinking that I messed up the crank seal so I was wondering if you have to spit the cases or not to do that seal in there.

I second that. I was dumb enough to split my cases and replaced the seal. All I needed to do was pull the gear and put a little silicon in the keyway and on the key. Which solved the leaking / smoking problem. Listen to Bill he's spot on this problem.
